Privacy Policy at EvyBenita.com
My name is Evy Benita and I’m an independent artist living in the UK. My website is located at https://www.evybenita.com. My UK-registered company is called Junkyard Jukebox LTD. This policy explains how I, under Junkyard Jukebox LTD, use your data.
You can contact me at info@evybenita.com or through the Contact Me page.
I do not, nor will I ever, sell your information. The information I store is purely for operational reasons, future design collections, and for your convenience.
Your personal details:
- I will use and/or store your name, username, billing address, delivery details, and your contact details.
Your financial details:
- I currently don’t offer the option to save your payment details on my site. But if this option is available in the future, and you choose to save your payment method, I will keep this information in my records.
- If you place an order in my store, I will keep a record of each order you place. This record includes: the type of items you purchased, your payment ID, time and date, the type of payment method you used, your choice of delivery method, your tracking number (if ordered), your personal data and contact data, the quantity of each item, and any additional notes you may leave.
- I keep record of the price you paid per item, the currency you paid in, and the overall price paid for your order.
Your search history:
I keep records of words searched for in the search bar on my site. These are anonymous and not connected to your account.
Your design preferences:
I go through orders and wishlists to see which product features are the most popular. This helps me determine which products to design in the future. I do not keep records of feature preferences on individual levels: it’s all anonymous and based on percentages.
Marketing preferences:
- If you contact me through my shop email or through any contact form on this site, I will keep record of the information you submit.
- If you register an account on my site, I will keep record of the information you submit.
- If you opt in for my newsletter, I will store the email address you’ve submitted.
You can update your marketing preferences at any time.
Product information:
- Each product in my store has a tariff code associated with it, which is used for customs and clearance. I keep record of this.
I do not, nor will I ever, sell your information. The information I store is purely for operational reasons, future design collections, and for your convenience.
Your personal details:
- I will use your name, delivery details and contact details to deliver your orders.
- If you opt in for my newsletter, I will use your submitted email address to send you newsletters by email.
Your financial details:
- Any saved payment information will be stored securely for your convenience only (i.e. if you save your bank card details for faster checkout)
- I use your email address to contact you regarding your order (i.e. if something has sold out, or if there’s an update on a product you’ve pre-ordered)
- I use anonymous purchase history to determine what products to restock and when, and if certain products sell better at certain times of year.
- If a package goes missing or if a payment dispute happens, I may use your contact details, payment ID or order details as documentation.
- When I ship your order, I may include an invoice on the outside of your box, which will most likely be inspected at border control. I’m legally required to include this to all orders entering the EU, for instance.
Want me to delete your order history? Simply pop me a message and I’ll sort it.
Your search words:
I keep anonymous track of search words so that I can see if there’s a particular animal, product or feature my visitors are looking for.
Example: if I see lots of people searching for “bunny” or “rabbit”, I might decide to design a collection of bunny pins.
I also track search words for accessibility. Example: if I notice that someone’s spelling a word or species name wrong, I will add the misspelled word as a keyword to all products to which it applies. That way, the products will still show up if the word is spelled incorrectly.
I may also use these search words in relation to online courses or trend forecasting products. Example: I might include popular search terms in a report of upcoming trends, and I might sell this report.
Please remember: the search words I use are anonymous. I won’t see who’s searched for what nor where the person is searching from.
Your design preferences:
I go through orders and wishlists to see which product features are the most popular. This helps me determine which products to design in the future.
Example: during my “Winter Series II” shop update, I learned that translucent enamel was a big favorite, and that the designs with yellow in them sold much less than those without yellow. This suggested that I should keep strong yellows to a minimum in future collections, and that I should test out more designs with translucent enamel.
If you’re a regular customer and I see you’re a particular fan of certain animals/colors/features, I may keep this in mind when designing new products. Remember: my business is small and I pack all orders myself, so if you’ve placed more than one order with me, it’s highly likely I know your name by heart.
I may share design popularity stats publicly and through commercial reports.
Example: I run a pre-order project, and on Instagram, I share a graph showing the percentage of popularity per pre-order design. Posts like these will never include identifying or generalising information. It’s purely anonymous data.
Marketing preferences:
- If you contact me through my shop email or through any contact form on this site, I will keep record of the information you submit.
- If you register an account on my site, I will keep record of the information you submit.
- If you opt in for my newsletter, I will use your submitted email address to send you newsletters.
You can update your marketing preferences at any time.
Legal requirements:
- If the police or authorities reach out to request your purchase history, and by law requires me to hand this over, I will have to do so.
- For orders shipping to outside of the UK, I will provide the delivery company with a detailed list of the contents of your package.
- My newsletters are written by me, and I do my best to keep them relevant to my brand and everyone who follows it.
- I do not base my emails on your purchase history: everyone who subscribes to my email newsletter will receive the same emails.
- If you’ve registered for an account and abandoned your basket, I may send you a discount or reminder by email.
You can unsubscribe from my marketing emails by any of the following methods:
- Click the “unsubscribe” button at the bottom of your last newsletter email from me.
I often include marketing flyers along with your orders. For example, if I have a Kickstarter campaign coming up, I might design a sneak-peek flyer and send this out with orders. My flyers are printed locally on fully recyclable and compostable paper. To speed up the compost process, you can shred the paper before tossing it in the compost bin (but don’t do this if you want to recycle it).
Don’t want a flyer? Simply write “no flyer please” as a note at checkout.
My marketing material predominantly mentions Evy Benita, but I may on occasion also mention my other businesses (i.e. The Lotls Games Co).
5. Who I share your personal data with
I will share your personal data with my delivery partners. At the moment I only ship through the following delivery companies:
- Royal Mail (most common)
- UPS (rarely)
I might add more companies in the future.
- The majority of my packages are shipped through Royal Mail. You can read their Privacy Notice here.
- If you place a wholesale order or an order weighing more than 2kg (ca. 75+ pins or 3-4 weighted plushies), I will most likely ship it through UPS instead. You can read UPS’s Privacy Notice here.
When I ship your order, the delivery company will receive your name, contact details and delivery details, plus any additional notes you’ve left at checkout that are relevant to delivering your order.
Please note: For international orders, the delivery company is likely to subcontract a local company in order to deliver your order (i.e. for orders going to Norway, Royal Mail will most likely subcontract Posten or Post Nord to bring your box to you).
If you live outside of the UK, I will also provide them with detailed information about the content of your package, and the price paid per item and total.
I reserve the right to refuse you service if I believe either of the following to be true:
- Your account was set up by a bot
- You’re placing test orders to see if you can get away with purchasing larger orders on someone else’s card
- Your account has been hacked
- You’re using a payment method that doesn’t belong to you
My shop does have strict password rules. I know this can be incredibly annoying, but it’s there to protect you and your account from being taken advantage of.
If I recognise an email or IP address that’s frequently trying to set up an account, but can’t pass the human verification steps, I reserve the right to block one or both of these.
PS: If you’re having genuine trouble getting through the human verification process, please reach out to me via email and I will happily set up an accommodated option for you.
7. How long I keep your data for
I keep your data for as long as I need to use it.
Order history is not deleted automatically, but I’m happy to delete it for you manually. If this is something you’d like me to do, please pop me a message and I will happily do so.
You have the following rights in relation to your personal data:
The right to be informed
I will give you information about how I use your personal data at the time I collect it from you, or through privacy notices such as this one.
The right to access your personal data
You have the right to receive a copy of your personal data and details of how I use it.
You can ask for details of the personal data I keep about you by contacting me. I might require proof of your identity, or ask you to confirm certain details of your account.
I will also need you to tell me which information and uses of your data you want to know about (for example, which of our services were involved and when I might have used the data). I may also ask you to fill in an optional application form to help me confirm your identity and trace the information you need.
The right to have your data corrected
You have the right to have your data corrected if it is wrong or incomplete.
I will do my best to make sure your personal data is accurate and up to date. However, I rely on you to check that some of the information I hold about you is accurate and up to date. Please let me know about any changes to your information (for example, by updating your account details on my website).
The right to object
You have the right to object to some uses of your personal data, such as for marketing (as set out in point 4 further up). However, if the law allows me to continue using your data, and I believe I still need it, I may do so.
The right to have your data deleted
You have the right to ask me to delete your personal data from my records if there is no legitimate reason for me to continue using it. Example: if you don’t need to see your order history from 1+ year ago, feel free to ask me to remove it.
However, if there is a legitimate reason for me to still use this information, I will not be able to delete it. Example: if you’ve placed an order and your payment portal warranty is still active, I will need to keep a record of your order until the warranty expires.
The right to restrict use of your data
You have the right to limit the use of your personal data if:
• you feel that it is not accurate and needs to be checked
• you disagree with my legal reasons for using your data and want me to reconsider using it
• I am using your data illegally, but you do not want it to be deleted, or
• I no longer require the data, but you want me to keep it for the purposes of a legal claim
The right to transfer your data
You have the right to ask me to transfer your personal data to another organisation. I must do this if the transfer is, as data protection law says, ‘technically feasible’.
This right only applies to personal data which you have given to me and which I use either with your agreement or to keep to a contract I have with you.
The right to withdraw your agreement to use personal data
If you have agreed I may use your personal data in a certain way, you can withdraw that agreement at any time.
The Information Commissioner’s Office (ICO) provides full details of your data protection rights.
You can reach me through any of the following channels:
